These terms and conditions apply to all services provided by Essex Spray Shop LTD

("Essex Spray Shop LTD").

Terminology

For the purpose of these terms & conditions, the following words have the following meanings:

• "Us/We/Our" refers to Essex Spray Shop LTD.

• "You" refers to you: the customer/client (the person or organization for whom we agree to carry out work and/or supply materials).

• "Tradesperson/tradespeople" refers to the employee(s) or subcontractor(s) appointed by Essex Spray Shop LTD to carry out work.

Invoices, Charges and Payments (1)

1.1 Upon your agreement for us to carry out estimated or pre-booked work, a deposit payment of 20% of the total will be requested immediately. If a deposit payment has been requested, no works will be carried out or services provided until settlement of the requested deposit has been cleared.

1.2 Commercial clients will be invoiced on completion with 30-day payment terms. Domestic clients are required to make full payment within 7 days of receiving the invoice. Essex Spray Shop LTD reserves the right to accrue and charge interest on any part of an invoice which remains unpaid after the due date at a rate of 10% over the base rate until payment is received by Essex Spray Shop LTD. Failing payment after 14 days (domestic) or 30 days (commercial), we reserve the right to increase the percentage to a further 15% over the base rate. Failing payment thereafter Essex Spray Shop LTD will automatically start legal claims proceedings at the full rate of the new invoice, and the client shall be liable to pay all costs, charges, fees and disbursements which can be reasonably incurred in the recovery of any unpaid invoices regardless of the value of the claim. There may be daily interest applied to any long-term outstanding debts until payment is cleared in full.

1.3 If the job is cancelled 5 days or more prior to the start date a full refund of the deposit will be issued. If cancelled 4 days or less the deposit paid is non-refundable. 1.3.1 Small jobs under £150 excluding VAT do not require a deposit.

1.4 If cancellation of a job on the client's behalf is less than 48 hours before the planned start date, then a fee/charge of £100 plus VAT will apply, regardless of the value of the job.

1.5 You accept sole liability to make payment in full unless you disclose when initially instructing us to carry out work and/or supply materials that you are acting on behalf of a third party.

1.6 Working hours are Monday to Friday, 8am–5pm with a one-hour lunch break. Any work outside these hours can/will be charged at a higher rate.

1.7 It is the customer’s responsibility to ensure permission, building warrants, access to site/job, or authorization for any/all work. Failure to supply permission, building warrants, access, or authorization will incur a charge of £120 plus VAT.

Guarantee (2)

2.1 For your peace of mind, we provide a 12-month guarantee on labour carried out by Essex Spray Shop LTD in respect of faulty workmanship only. This is active from the date of completion of work, in addition to any manufacturer’s warranty/warranties. The guarantee will become null & void if the work/appliance completed/supplied by us is:

• Subject to misuse or negligence.

• Repaired, modified, or tampered with by anyone other than an Essex Spray Shop LTD tradesperson. We will accept no liability for, or guarantee suitability of, materials supplied by you, and will accept no liability for any consequential damage or fault.

We will not guarantee any work in respect of:

• Any work undertaken on instruction from you and against the written or verbal advice of the Essex Spray Shop LTD tradesperson. 2.2 Work is only guaranteed in respect of work directly undertaken by us and where full payment has been made.

2.3 Any non-related faults arising from recommended work which has not been undertaken by us will not be guaranteed.

2.4 Where we agree to carry out work on installations of inferior quality (or over ten years old) no warranty is given in respect of such work and we accept no liability in respect of the effectiveness of such work or otherwise.

2.5 Any warranty work will be carried out by one Essex Spray Shop LTD tradesperson only.

Liability (3)

3.1 We will only be liable for rectifying our own guaranteed work and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested and not undertaken at the time.

3.2 We will not be held liable or responsible for any damage or defect resulting from work not fully guaranteed, or where recommended work has not been carried out.

3.3 Work will not carry a guarantee where you have been notified by the tradesperson either verbally or indicated on any supporting documents, invoices, quotations, or certificates.

3.4 We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such a delay is due to any cause beyond our reasonable control and we shall be entitled to reasonable time extensions.

3.5 Due to the nature of spray work, Essex Spray Shop LTD will not be held liable for any overspray, incidental damage, or claims relating to the surrounding areas, surfaces, fixtures, or property. While every effort is made to protect your property, you acknowledge and accept that minor overspray and associated risks are inherent to the spraying process.

Title to Goods (4)

4.1 Goods supplied and delivered by us to you, or your premises, shall remain our property until paid for by you in full. Whilst goods remain our property, we have the absolute authority to:

• Retake, sell or otherwise deal with or dispose of all or any part of these goods.

• Enter any premises, at any time and without notice, in which goods or any part thereof is installed, stored, or kept or is reasonably believed so to be.

• Seek a court injunction to prevent you from selling, transferring or otherwise disposing of such goods.

4.2 The risk in such goods will pass on to you upon delivery. You must insure them at replacement value, and if asked you must produce evidence that they are properly insured.

General

These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorized representative and you. Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions. These terms and conditions, and all contracts awarded between us and you, shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English courts.
